These General Terms and Conditions (\u201cTerms\u201d) apply to every order placed by a visitor to the webshop (\u201cCustomer\u201d).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When placing an order, the Customer must expressly accept these Terms and Conditions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Additional terms and conditions of the Customer are excluded, unless previously accepted in writing by SOGO.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u200b<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Article 2 - Prices<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">All prices are expressed in euros and include VAT. Any shipping, handling, or reservation fees will be listed separately. When providing a valid VAT number for cross-border transactions, the price will be shown excluding VAT during the checkout process. The validity of the VAT number will be automatically checked via the VIES system. If the number proves to be invalid, VAT will still be charged.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Photos on the website are for illustrative purposes only and may contain elements that are not included in the price.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u200b<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Article 3 - Offer<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Despite the fact that the online catalog and the e-commerce website are compiled with the greatest possible care, it is still possible that the information offered is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer do not bind SOGO.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">SOGO strives to keep product inventory and availability as accurate as possible. However, it may unexpectedly happen that an item is out of stock at the time of order processing. In that case, the Customer will be notified as soon as possible and a suitable solution will be offered (refund, replacement product, or later delivery).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For certain items, such as glazes or books, pre-orders may be offered. In that case, an estimated date will be provided on the product page when the item will be available or can be shipped.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This date is indicative and not binding, and may be changed due to circumstances such as production planning, delivery delays, force majeure, or other external factors. SOGO undertakes to inform the Customer in good time of any changes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The offer is valid while stocks last and can be adjusted or withdrawn by SOGO at any time. SOGO cannot be held liable for the unavailability of a product.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When the Customer has specific questions about sizes, color, availability, delivery time, or delivery method, they are asked to contact SOGO in advance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u200b<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Article 5 - Delivery of Products<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Physical products are shipped weekly on Tuesdays after payment is received, unless otherwise specified. All orders placed before Tuesday 10 AM will be included in the shipment and therefore will, in principle, also be delivered that week.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Delivery is standardly via bpost, but other carriers are not excluded. B2B orders, for example from stores, are regularly handled by a pallet carrier. SOGO is not liable for delays caused by the carrier.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u200b<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">5.1 Delivery Times<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The stated delivery times are indicative and not binding. Delays caused by the carrier, force majeure, or external circumstances can never lead to compensation for damages. SOGO does undertake to inform the Customer as soon as possible in case of deviations. The Customer undertakes to contact SOGO if a package is not delivered or is delivered late, so that an investigation can be initiated.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u200b<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">5.2 Loss or non-delivery<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In case of loss, late delivery, or non-delivery by the carrier, SOGO is responsible if the correct shipping information was provided by the Customer.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This specifically means that SOGO:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>contacts the carrier<\/li>\n\n\n\n<li>start a research<\/li>\n\n\n\n<li>in search of a solution with the customer<\/li>\n\n\n\n<li>provide a replacement product or refund the order when the package turns out to be lost or damaged<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If the Customer provides incorrect shipping information that leads to non-delivery or return, SOGO cannot be held liable. The Customer will be responsible for any additional costs incurred for reshipping the package.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u200b<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">5.3 Damage on Delivery<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Any visible damage, missing item, or quality defect must be reported to SOGO immediately and no later than 48 hours after delivery, with photos of:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the outer packaging<\/li>\n\n\n\n<li>the inner packaging<\/li>\n\n\n\n<li>the damaged product<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Without timely notification, SOGO cannot open a claim with the carrier, and the right to replacement or refund will be forfeited.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u200b<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">5.4 Delivery outside Europe<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Delivery outside of Europe is possible under specific conditions and after consultation. Any customs fees or import duties are always the responsibility of the Customer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u200b<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Article 6 \u2013 Workshops<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This article exclusively concerns workshops given by SOGO, for which registration also takes place through SOGO. For other workshops where SOGO is present as a guest instructor at someone else's studio, the rules of that respective studio apply. SOGO cannot be held liable for errors, problems, or cancellations of those workshops.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u200b<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">6.1 Cancellation by the Customer<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In case of cancellation by the Customer, an administrative fee of \u20ac20 will be charged if the invoice has already been generated. If the invoice has not yet been created and\/or sent, the administrative fee will be waived.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In addition, the following conditions apply:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cancellation up to 30 days before the workshop: full refund.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Between 30 and 14 days: 50% refund unless a replacement is found.<\/li>\n\n\n\n<li>Less than 14 days: no refund unless a replacement is found.<\/li>\n\n\n\n<li>The customer may always send a replacement themselves.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">\u200b<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">6.2 Cancellation by SOGO&nbsp;<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In case of cancellation by SOGO due to force majeure (e.g., illness), the full registration fee will be refunded. Further compensation is excluded.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u200b<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">6.3 Liability<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Participants participate at their own risk. SOGO Ceramics is not liable for damage to personal property or bodily injury, except in cases of intent or gross negligence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">All practical information about workshops (location, duration, content, materials, what to bring, etc.) is clearly stated on the workshop's product page. Registration is only final after payment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u200b<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Article 7 \u2013 Right of Withdrawal<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">7.1 Products<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Consumers have 14 days to revoke the purchase. The goods must be returned in their original condition and properly packaged. Return shipping costs are the responsibility of the Customer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u200b<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">7.2 Exceptions<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">No right of withdrawal for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>custom-made products<\/li>\n\n\n\n<li>workshops with a fixed date for orders&nbsp;<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">\u200b<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Article 8 \u2013 Warranty<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The statutory warranty of 2 years applies to physical products. The (commercial and\/or statutory) warranty never applies to defects resulting from accidents, neglect, drops, use of the item contrary to its intended purpose, failure to follow the instructions or manual, modifications or alterations to the item, rough handling, poor maintenance, or any other abnormal or incorrect use.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Defects manifesting after a period of 6 months following the date of purchase, or delivery if applicable, shall be presumed not to be latent defects, unless proven otherwise by the Customer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u200b<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Article 9 \u2013 Customer Service<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Customer service is exclusively available by email or phone.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">SOGO&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"mailto:sofie@sogokeramiek.com\" target=\"_blank\" rel=\"noreferrer noopener\">sofie@sogokeramiek.com<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">+32 476 68 39 22<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u200b<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Article 10 \u2013 Non-payment<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Without prejudice to the exercise of any other rights available to SOGO, in the event of non-payment or late payment, the Customer shall, as of the date of default, be liable by operation of law and without notice of demand to pay interest at a rate of 10% per year on the unpaid amount. In addition, the Customer shall be liable, by operation of law and without notice, for a lump-sum compensation of 10% on the amount in question, with a minimum of 25 euros per invoice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Notwithstanding the foregoing, SOGO reserves the right to repossess the items that have not been (fully) paid for.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u200b<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Article 11: Privacy<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">SOGO processes personal data in accordance with the General Data Protection Regulation (GDPR \u2013 Regulation (EU) 2016\/679). This privacy policy has been drafted in accordance with the GDPR and the Belgian Law of July 30, 2018, concerning the protection of natural persons with regard to the processing of personal data.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The website and webshop were created with WooCommerce. WooCommerce manages and provides the tools with which SOGO keeps track of data from people who contact SOGO via the contact form or register on the website. The personal data you provide will only be used for the following purposes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>sending sporadic newsletters (provided express consent is given)<\/li>\n\n\n\n<li>Contact<\/li>\n\n\n\n<li>sending out quotes and invoices<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">You have a legal right to access and potentially correct your personal data. If necessary, you can also request that data which is inaccurate, incomplete, or irrelevant be corrected.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In case of use of data for direct marketing: You can object to the use of your data for direct marketing free of charge. For this purpose, you can always contact SOGO \u2013\u00a0<a href=\"mailto:sofie@sogokeramiek.com\" target=\"_blank\" rel=\"noreferrer noopener\">sofie@sogokeramiek.com<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We treat your data as confidential information and will not share, rent, or sell it to third parties.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The customer is responsible for keeping their login details and password confidential.
